Terms of Service
This User Agreement regulates the relationship between the user (hereinafter referred to as the User) on the one hand and Easyfind OÜ (hereinafter referred to as Easyfind OÜ) on the other hand (the User and Easyfind OÜ hereinafter referred to as the Parties) in the easyfind online environment (hereinafter referred to as easyfind).
By registering and using the easyfind online environment, the user confirms that:
- he/she has read, accepts and agrees to be bound by the terms and conditions of this Agreement;
- he/she has read, agrees with and undertakes to abide by easyfind’ s online privacy policy.
1. Definitions
1.1. easyfind – The virtual environment, sub-pages and pages on social networks on the website www.easyfind.ee, which are owned by Easyfind OÜ with the registration code 16841931.
1.2. User – a natural or legal person registered in the easyfind online environment.
1.2.1. Registered User – a natural person who is registered in the easyfind online environment;
1.2.2.2. Business Customer – a legal entity registered in easyfind’s online environment;
1.2.3. ‘ Ordinary User ‘ means a natural or legal person who uses the online environment but has not registered.
1.3. Account – a virtual account of a natural or legal person in an easyfind online environment.
1.4. service – the service provided to the User by Easyfind OÜ (including the service of using the easyfind internet environment provided to the User, which consists in the creation of an account(easyfind account) for the User for the electronic handling of his/her advertisements/advertising).
1.5. Price list – a document setting the prices (fees) for the services of Easyfind OÜ, which is available at. here and is an integral annex to the User Agreement.
1.6. working day – a calendar day (between 9:00 and 17:00 from Monday to Friday) which is not a national holiday.
1.7. Contract – a document that regulates the relations between Easyfind OÜ and the User, and sets out the legal basis.
1.8. Kasutustingimused – The General Terms and Conditions for the use of the easyfind online environment and the Services established by easyfind OÜ, which are available on the easyfind website. here
1.9. Legislation – Legislation in force in Estonia.
1.10. ‘ Personal data ‘ means any information relating to an identified or identifiable natural person (data subject).
1.11. User Level – The rights and obligations granted to the User to use the easyFind online environment and Services (Regular User, Registered User or Business User);
1.12. ‘ Work’ means written text (advertisements, advertisements, opinions, reviews, expert opinions, etc.), photographic works and works obtained by analogy with photography, slides and slide films, short videos, audiovisual works, illustrations, etc.
2. basic terms and conditions for using the easyfind online environment
2.1. easyfind’s online environment is intended for the provision of the Services to the User.
2.2. easyfind may only be used in accordance with the Terms of Use. If the User does not agree to the Terms of Use, he/she shall not be entitled to register in the easyfind online environment.
2.4. In addition to the Terms of Use, Easyfind OÜ may impose Additional Terms and Conditions for the Service offered in the easyfind online environment. If the User does not agree to the Additional Terms and Conditions of the respective Service, he/she shall not be entitled to use this Service. The Additional Terms are part of the Terms of Use.
2.5. easyfind website may only be used with general purpose web browsers such as (but not limited to) Firefox, Internet Explorer, Opera, Chrome, etc. easyfind website may not be used with programs that send automatic requests to easyfind website for any purpose.
2.6. In order to use the easyfind Internet environment , the person must conclude a Contract with Easyfind OÜ. The Terms of Use are the terms and conditions of the Agreement. The User and Easyfind OÜmay agree to contractual terms and conditions that differ from or supplement the Terms of Use.
2.7. The User is obliged to thoroughly study the Terms of Use before entering into the Agreement.
2.8. Depending on the User Level, the conclusion of a Contract with Easyfind OÜ is as follows:
2.8.1. when the User actually starts using the Services (a “Standard User”);
2.8.2. if the User has submitted an application for registration via the easyfind online environment and receives access to a personal easyfind user account (Registered User);
2.8.3. The company has submitted an application for registration via the easyfind online environment and can access the easyfind business account (Business Client).
2.9 If the User wishes to use easyfind in a manner or for a purpose other than that provided for in the Terms of Use, Easyfind OÜ’s prior written consent is required. Without the prior written consent of Easyfind OÜ, the use of the easyfind Internet environment in any other manner or for any other purpose than that stipulated in the Terms of Use is prohibited.
2.10. The User is obliged to pay for the use of easyfind’s Services in accordance with the Price List, unless otherwise provided in the Agreement.
2.11. The conditions for concluding a contract with Easyfind OÜ:
2.11.1. In order to enter into a contract with Easyfind OÜ, the User must be an adult (at least 18 years of age).
2.11.2. The Contract may be concluded on behalf of a legal person by its legal representative.
2.11.3. In order to sign a contract, you need to be able to use mobile-ID, smart-ID or ID-card.
3. User levels
3.1 The following User Levels have been defined in the easyfind online environment:
3.1.1. ordinary user – can use the Services of the easyfind online environment to a limited extent and does not need to create a personal easyfind user account. The rights and obligations of a Registered User do not apply to an Ordinary User;
3.1.2. registered User – can use the Services of the easyFind online environment and offer his/her goods and services to other Users, give ratings to Users with whom he/she has made transactions. In addition, the Registered User shall be subject to the rights and obligations set out in the Terms and Conditions of Use of the easyfind online environment.
3.1.3. business Customer – can use the easyfind Services and offer his/her goods and services to other Users, give ratings to Users with whom he/she has transacted and only the Business Customer can publish information about the sale of used items.
3.2. The ordinary user has the right to:
3.2.1. familiarise yourself with the Content of the easyfind online environment;
3.2.2. search in databases (the Standard User can only see the names of other Users, but not their contact details and information published by them), use other Services available to the Standard User;
3.2.3. create a personal easyfind user account (Registered User) or a Business Customer account. In both cases, a contract must be concluded with Easyfind OÜ, accepting the easyfind Terms of Use and Privacy Policy.
3.3. A Registered User is entitled to:
3.3.1. log in to easyfind;
3.3.2. store data on Users of interest in the easyfind personal user account;
3.3.3. receive new ads by email from saved Users of interest;
3.3.4. see and contact a registered User via the easyfind website. Send purchase requests to sellers of a product, service or other service of interest, ask for further information;
3.3.5. give your rating as a Business Customer/Registered User and leave your feedback on the goods or services received in the comments.
3.3.6. use any other Services available to a Registered User.
3.3.7. post your ads, promotions, discounts and other campaigns.
3.4. The Business Customer has the right to:
3.4.1. log in to the easyfind online environment;
3.4.2. use the Services available through the Business Customer’s account and other Services in accordance with the agreement concluded with Easyfind OÜ;
3.4.3. authorise natural persons acting on behalf of the company to use your user account.
3.4.4. reklaamida easyfind second-hand items via the online environment.
4. Registration, Duration and termination of the User Agreement
4.1. When registering, the User must provide the mandatory data required by Easyfind OÜ, marked with an asterisk, accept the Terms of Use and Privacy Policy and the price list, for which the User clicks on the dedicated field created by Easyfind OÜ in the user interface.
4.2 Upon registration, in addition to other rights, the User will also receive a personal easyfind user account, in the case of a company, a business client account.
4.3. If a User has both a User Account and a Business Account, the User can choose to use either a User Account or a Business Account.
4.3 If the User fails to pay on time for the use of easyfind’s online environment services, his/her account will automatically become inactive and other Users will not be able to see the information related to the account and the User will not be able to publish the information.
4.3.1 If the User wishes to reactivate his/her account, in case it or parts thereof have not been deleted in accordance with the terms for storage of Personal Data under the Privacy Policy, the User shall pay the prescribed amount and/or the amount owed for the use of easyfind’s services in accordance with the applicable price list, after which the account shall become active no later than one working day after the financial obligation has been fulfilled and a notification thereof has been sent to Easyfind OÜ.
4.4. The User’s registration in easyfind is valid indefinitely. The User’s account is active once the User has paid for it in accordance with the price list. The User can choose the duration of the active period, either one month or one year.
If the User has not used his/her User Account or Business Account for 365 days, Easyfind OÜ will issue a deletion warning to the User. If the User fails to respond to this warning, Easyfind LLC will delete the User Account or Business Account.
4.5. The Customer has the right to cancel the User Agreement and close the User Account at any time.
4.6. In the event of a material breach of the terms and conditions of the Agreement on the part of the User,Easyfind OÜ shall have the right to terminate the User Agreement exceptionally.
5. Identification of the person and user account
5.1 The Registered User and the Business User are obliged to keep the information necessary to enter the easyFind environment confidential and in such a way that it does not fall into the hands of third parties, unless the Registered User has authorized a third party to use his/her data to access the Services.
5.2. The User must immediately notify Easyfind OÜ of the loss of his/her user ID or password or of its falling into the possession of persons to whom he/she has not given the right to use the data. The notification must be digitally signed.
5.3. The user is responsible for transactions made using his/her account or information published on his/her behalf.
5.4. In order to use certain Services, Easyfind LLC may require the User to identify himself/herself by means of ID-card, Mobile-ID, Smart-ID.
6. User rights, obligations and restrictions
6.1. easyfind allows the User to register and use only one Registered User Account, but the User may be associated with one or more Business Accounts.
6.2 The User has the right to purchase services or products published in easyfind’s online environment, and to publish an advertisement or advertisement on his/her behalf, only in relation to the service offered or product sold by the User.
6.3 The User undertakes to behave in the easyfind online environment in accordance with the User Agreement and the legislation of the Republic of Estonia.
6.4 The User undertakes to be responsible for the content, quality and availability of the advertisements, services and products published in the easyfind online environment, as well as for the accuracy of the presentation.
6.5 The User is responsible for the proper fulfilment of the obligations undertaken in the easyfind online environment.
6.6 The User is obliged to provide only correct data in the easyfind online environment.
6.7 The User is obliged to immediately notify Easyfind OÜ of any problems in using the easyfind Internet environment, clearly stating the nature of the problem.
6.8. The User is obliged to inform Easyfind OÜ of any circumstances that may prevent the proper fulfilment of these Terms and Conditions.
6.9 The User grants Easyfind OÜ non-exclusive ownership of the audiovisual content of its advertisements, including texts, and undertakes to refrain from any activity that could place an excessive load on the infrastructure of the easyfind Internet environment.
6.10. The User undertakes to refrain from using any automated programs to collect or access information contained in the easyfind online environment.
6.11. The User is obliged to ensure that the files he/she enters on the Website and the e-mails he/she sends to the EasyFind Internet environment or to another User do not contain any computer viruses or other computer programs or files that damage or otherwise interfere with or may damage or interfere with the normal functioning of the Website, as well as those programs or files that may be stored on the computers of other Users of the Website, damage or interfere with the normal functioning of such computers.
6.12. It is forbidden to use another person’s copyrighted Work or a derivative Work without the consent of the copyright owner (author, performer, licensee, employer, database maker, etc.) of that Work and of the Work. The User warrants that the inclusion of the Work in easyfind is in accordance with the law.
6.13. If a User publishes value judgments in easyfind’s online environment about another User or about a product or service offered by another User, they must be honest and objective, and in the event of a dispute, the provider of the value judgment must be able to justify and substantiate his/her assessment.
6.13.1. The value judgment must not be defamatory, degrading, insulting or offensive to the honour and good name of another person and must not be intended to maliciously or unjustifiably disparage a service or product.
6.13.2. The User takes into account that the transmission of false information may cause damage to another User or to the manufacturer of the product, and the latter shall be entitled to claim, inter alia, compensation for the damage caused.
6.13.3. The User is aware that OÜ Easyfind will forward the data of the User who has provided the valuation to the person who considers that his/her rights have been violated by the incorrect valuation.
6.13.4. The User is aware that OÜ Easyfind does not control the published valuations.
6.13.5. Incitement to hatred or hatred, persecution, discrimination on grounds of sex, racial or ethnic origin, religion or belief, inequality in property or social status are also prohibited.
6.13.6. Only the User who has purchased the product or consumed the service can give a value for the product or service. The value assessment cannot be based on claims made by third parties.
6.13.7. Easyfind OÜ has the right to delete and/or suspend the publication of the ratings.
6.14. It is forbidden to overload the easyfind centre with information that is not related to the purpose of the centre.
6.15. The User is obligated to keep confidential any personal data and confidential information, including, but not limited to, the identity of other Users, that has become known to him/her in the course of using the easyfind online environment, unless the right or obligation to disclose such data or information arises from law or the disclosure has the consent of the relevant person.
6.16. Easyfind OÜ shall have the right, BUT NOT THE OBLIGATION, to control the information added by the User and the actions of the Users in the easyfind online environment and to remove inappropriate information or to restrict the publication of inappropriate information or inappropriate actions.
6.17. Easyfind OÜ shall not be obliged to monitor the activities of Users or any information submitted by Users via the easyfind online environment, transmitted, cached or stored by them, or to search for facts or circumstances confirming illegal activities. However, Easyfind OÜ is obliged to provide information to the competent authorities, such as the Police and Border Guard Board, the Data Protection Inspectorate, the Tax and Customs Board, etc., upon their request.
6.18. Any dispute between the User and Easyfind LLC will be settled by negotiation. In the event that a negotiated solution cannot be found, the dispute shall be settled in accordance with the procedure provided for by the legislation of the Republic of Estonia, in the case of a legal entity User in the Harju County Court.
6.19. Easyfind OÜ and the User may not publish links to third party websites in the easyfind online environment.
6.20. Third-party services and websites may have terms and policies that differ from the Terms of Use and Privacy Policy, the implementation of which Easyfind OÜ cannot control. Easyfind OÜ is not responsible for the content, actions or practices, rules and policies of third party services and websites. It is the responsibility of the user to acquaint himself/herself with the practices, rules and principles of third party websites.
6.21. The User has the right to send complaints to Easyfind OÜ regarding the functioning of the website or violations by other Users. These should be sent by e-mail to the following address: easyfind@easyfind.ee.
7. Publication of advertisements and use of other services
7.1. When submitting advertisements, photos, videos, advertisements and texts, the User is obliged to provide only correct and accurate information. The User is forbidden to disclose any information that is misleading or inaccurate. The texts, photos, videos and data published by the User through the easyfind online environment must comply with the law, good practices and customs. By agreeing to these Terms of Use, the User acknowledges that the information he/she discloses through the website:
7.1.1. are not misleading, inaccurate or untrue;
7.1.2. do not contain offers to provide services or to sell goods the provision or sale of which is not in accordance with the law;
7.1.3. do not infringe the proprietary or non-proprietary rights of third parties, including intellectual property rights belonging to third parties;
7.1.4. are not contrary to the law or to accepted principles of morality and good practice.
7.2. The user is responsible for the (correctness) of the data he/she publishes.
7.2.1. Easyfind OÜ shall not be liable for the accuracy of the information published by the User or for the quality of the product or service offered by the User or for the performance of the contract concluded between the Users.
7.3 The User undertakes to inform Easyfind OÜ immediately by e-mail if any of the data published by him/her via the easyfind website has become inaccurate, incorrect or illegal after publication.
7.4. Easyfind OÜ has the right to select its contractual partners at its own discretion.
8. Basic terms and conditions for advertisements
8.1 The advertisement must be clear, the information published therein must be true, i.e. the advertisement must not give the unjustified impression, for example, that the information provided has a scientific basis (RekS § 3 (4) p 11 and p 14).
8.2. The User acknowledges that it is his/her responsibility to prove the veracity of any (advertising) claims.
8.3. When publishing information, the user must comply with, among other things, the Advertising Act.
8.3.1. Section 3 of the Advertising Act sets out the basic requirements for advertising, and subsection 4 of the same section sets out the restrictions that the User must observe when publishing information on the easyfind portal.
8.4. Processing an advertisement, photo or other file for the purpose of attracting attention is prohibited.
8.5. The photos or other files attached to the photo fields of the advertisement can be of specific products/services as well as different ones. It is up to the user to choose the design of his/her ad/advertisement and the way in which the information is communicated to others, but this must be in line with the easyfind online environment.
8.6. The user sets in their account which words are used as keywords (which words make it easier to find a specific product or service). The search words must be either one or a maximum of two words, and must be clear and specific (e.g. “hairdresser”, “house cleaning”, “washing machine repair”, etc.). There is no limit to the number of words, but the words must be related to the User posting the ad and/or to the User’s business.
8.7. Rules for the “Work/workplace rental” category.
8.7.1.Principles
- Töökuulutuses toodud ametinimetus ja töökohustuste sisu, peavad olema vastavuses, et oleks selge, millised on töökohustused ja/või ametikoht;
- The duties and conditions of the job, including those relating to the candidate (e.g. knowledge of foreign languages, driving licence, etc.), must be spelt out as clearly as possible;
- Only the legal representative of the company offering the job can post a job advertisement.
8.7.2. If a ‘job offer’ is made (hairdressers, beauty services), it must be clearly distinguishable from the job advertisement.
8.7.3. The title of the advertisement must contain only the name of the job (in nominative form).
8.8. Keelatud on avaldada infot:
- a product or service the sale or supply of which is illegal;
- on intimate services;
- in which the published content is in conflict with the Advertising Act or any other legal provision of the Republic of Estonia;
- which is contrary to the licence agreement;
8.9. It is forbidden to publish advertising about the following persons or services:

8.10. Only the information that belongs in the field (the field name) should be added to the fields provided.
8.11. Texts must comply with spelling rules. It is forbidden to use inappropriate punctuation marks or to repeat punctuation marks, for example: ‘very good goods!!!!!!!!!!!!!!!’. etc
8.12. Advertisements must correspond to the heading under which they are to be published. For example, it is forbidden to include car repairs or other advertisements under the heading of organic products.
8.13. The user can make links to his/her own website and online shop.
8.14. The User is allowed to advertise his/her company or activity by means of images, texts, pdf files, shortvideos, slides and slide films.
8.15. Used Products may only be sold or advertised by the Business Customer.
8.16. The User is not allowed to sell prohibited goods, services or products that violate Easyfind OÜ’s intellectual property rules, even if they comply with Easyfind OÜ’s other market conditions.
8.17. In the handmade (goods) category, resale is prohibited. Resale means the offering for sale of a handmade item that is not a product designed or manufactured by the User.
Please note that members and, in some cases, third parties may report advertisements that they believe violate Easyfind OÜ rules or the interests or rights of a third party, such as a manufacturer, product reseller, item owner, etc., and ask Easyfind OÜ to review them, including suspending or requiring the publication of the identity of the person posting the information. Easyfind OÜ may remove any advertisements or other information or data that violate the Easyfind OÜ User Agreement. In the event that Easyfind OÜ suspends the use of the User’s account due to any violations, the money paid for the services will not be refunded.
9. Conclusion of sales transactions and liability
9.1. easyfind OÜ shall not itself participate (for example, as an agent, broker, commission agent, representative or otherwise) in actual sales and other transactions between Users as a result of offers published in the easyfind online environment.
9.2 Users shall conclude sales transactions in the easyfind online environment without the intervention of Easyfind OÜ and shall be fully responsible for the performance of the agreements concluded between them and the terms and conditions of sale.
9.3 The User understands and acknowledges that if the other party to the transaction, who sells something or offers a service, is not a trader, the contract concluded between the Users as a result of the offer published on easyfind’s online environment is not subject to the consumer rights arising from the European Union consumer protection.
9.4. In the event that Easyfind OÜ becomes aware of an infringement or persistent infringement of the law by means of the website, it will remove or block access to the relevant content. Easyfind OÜ shall not be liable for any infringements committed or continuing to be committed on or via the easyfind Internet environment or for the consequences thereof, even if such consequences are the result of a breach of contractual obligations between the two Users.
9.5. Easyfind OÜ shall not be liable for any damage suffered by the User or third parties as a result of Easyfind OÜ exercising its remedies (for example, removing content from the Website, blocking access to it, restricting the User’s rights or blocking the User’s access to his/her user account or the Website), if this was necessary due to a complaint about a breach by Easyfind OÜ or due to suspicion of a breach by Easyfind OÜ or directly because the content or the User’s conduct is in breach of the Terms of Use, good practice or the law. In such a case, Easyfind OÜ shall not be liable for the damage suffered, even if the complaint was unfounded or if it later transpires that there was no infringement.
9.6 If the User has used another person’s copyrighted work or a work derived from it in the easyfind Internet environment or has otherwise infringed someone’s copyright, Easyfind OÜ shall not be liable for any damage caused to the User or third parties by the use of such work. The User shall settle all such disputes and shall bear the corresponding costs.
9.7. Easyfind OÜ shall not be liable for the quality, quantity, location, accessories, origin or legality of the goods sold, nor for the quality of the service provided by the User. This is the responsibility of the User who sells the goods or offers the service or who has published the relevant advertisement.
9.8. OÜ Easyfind OÜ is not a party to any disputes between Users and does not settle any claims of a User against another User regarding a product, service, copyright or other rights infringement.
10. Rights and obligations of Easyfind OÜ
10.1 Easyfind OÜ has the right to unilaterally amend the Terms of Use and the price lists in accordance with the development of the Services and the easyfind website.
10.2. easyfind OÜ may amend the Terms of Use in the event of a change in the applicable legislation or its interpretation, the introduction of a new Service or the termination of the existing Service, in response to ongoing complaints by Users, the publication of a court decision or administrative act which has entered into force and which obliges easyfind OÜ to amend the Terms of Use, if necessary to enhance the protection of User data, in the event of changes in the organisation of the easyfind Internet environment, the administration of the easyfind website or technological developments which improve the quality and security of the Services.
10.3. Easyfind OÜ will inform the Users of changes to the Terms of Use or price lists via the Website in good time before the introduction of new Terms of Use or price lists. If the User continues to use the easyfind Website and the Service after the expiry of this period, he/she shall be deemed to have accepted the changes to the Terms of Use and/or the price lists. The amendments which have entered into force shall not apply to Services for which payment has been made or which have been concluded prior to the entry into force of the amendments.
10.4. easyfind OÜ has the right to restrict the User’s rights to use the easyfind website or to terminate the User’s registered status in the event of the User’s breach of these Terms of Use. In certain cases, an additional period of time shall be granted to remedy the breach, which shall depend on the extent, content and possible consequences of the breach, including the existence of previous breaches.
10.5. easyfind OÜ has the right, but not the obligation, to check the advertisements, texts and photos submitted by the User on the easyfind website and to remove any advertisements that contain inaccurate or misleading information, the publication of which would constitute an infringement of the law or the publication of which would otherwise be in breach of the Terms of Use.
10.6. easyfind OÜ reserves the right to restrict access to the easyfind website to persons who do not comply with these Terms of Use or who violate any laws when using the easyfind website. In the event of a restriction of the User’s rights, the User shall be informed thereof and any disputes shall be settled by negotiation at or in court.
10.7. Easyfind OÜ reserves the right not to refund any fees paid to the User for the Service, if the User decides to withdraw from the Service before the expiry of the term of the Service or if the Agreement is terminated due to a breach by the User.
11. Autoriõigused
11.1 Easyfind OÜ owns all copyrights and related rights (database maker’s rights) to the databases and the works contained therein, including software, news, messages, texts, graphic, musical and other designs published by Easyfind OÜ.
11.2. The Works in respect of which, for the purposes of this Chapter, the author’s proprietary rights are assigned and an exclusive licence is granted in respect of the personal rights are the written texts published or made public by the User in the easyFind environment, including, but not limited to, advertisements, forum messages, opinions, reviews, expert opinions, etc., photographic works and works obtained by analogy with photography, slides and slide films, audiovisual works, illustrations, etc..
11.3. The User assigns to Easyfind OÜ, free of charge, all proprietary rights to the Work within the meaning of the Copyright Act listed in clause 11.2, including the rights to reproduce, distribute, translate, process, collect and compile databases, publicly perform, make available to the public, etc., in any form and in any manner, without geographical limitations and for the entire term of the copyright, without limitations in relation to third parties. The proprietary rights shall be deemed to be assigned to Easyfind OÜ immediately upon uploading the Work to the Easyfind OÜ environment.
11.4 The User grants Easyfind OÜ an exclusive licence (permission) free of charge to use the User’s personal rights in the easyfind Internet environment in any form and manner within the meaning of the Copyright Act for the entire term of the copyright, without any geographical limitations and without any limitations in relation to third parties. The User shall limit the manner and scope of the exercise of his/her personal rights as set out in the Terms of Use. Easyfind OÜ shall be entitled to issue sub-licences in respect of the User’s personal rights. An exclusive licence shall be deemed to have been granted by the User to Easyfind OÜ immediately upon uploading the Work to the easyfind environment. The exclusive licence granted on the basis of the Terms of Use shall cover all further developments of the Work. The User permits, if necessary, to make any changes to his Work and to the designation of the User’s name, to add other works, illustrations, comments, etc. to his Work. The User agrees that Easyfind LLC is not obliged to include the User’s author name in the Work.
11.5. Easyfind OÜ has the right to create derivative works based on the User’s Work by further developing the Work. The copyright in the derivative works belongs to Easyfind OÜ. The User agrees that Easyfind OÜ shall not be obliged to indicate in the derivative work the name of the User as the author of the original Work, the title (title) of the Work or the source where the Work was published. Derivative Works are, for example, photographs uploaded by the User to the easyfind environment with additions, alterations or other additions (including changing the dimensions of the photographs, changing the file name, enhancing the quality of the photograph, adding a watermark, etc.). Easyfind OÜ shall have the right to delete Works (e.g. photographic Works) uploaded by the User to the easyfind Internet environment and to use only derivative Works created by Easyfind OÜ in the easyfind environment.
11.6 The User and other persons are not entitled to reproduce (copy), distribute, transmit, translate, incorporate into other databases, make extracts, etc. in any way whatsoever the easyfind environment and its components without the prior written consent of Easyfind OÜ.
11.7 Use of the Easyfind Works or any of the Easyfind Works or any of the Easyfind Works by the User or any other person without the consent of Easyfind OÜ shall be unlawful and shall entail the liability provided for by law.
11.8 By accessing the easyfind online environment, the User confirms that he/she is aware of the Easyfind OÜ copyright and the associated rights (database maker’s rights) and that he/she undertakes not to infringe the Easyfind OÜ rights and not to allow other persons connected to him/her with Easyfind OÜ rights to do so.
11.9 By including a Work or Content in the easyfind Environment, the User acknowledges that he/she owns the copyright or other intellectual property rights to that Work or Content or has another legal basis for including the Work or Content.
11.10. Easyfind OÜ and the User shall be liable for the infringement of copyright requirements set out in this section of the Terms of Use, subject to the exceptions set out in the section of the Terms of Use “ Easyfind OÜ Liability” (see section 14 of the Terms of Use).
12. Quality and accessibility of services
12.1. Easyfind OÜ may, if necessary, in order to provide the Users with the best possible service, update the mechanisms underlying the operation of the easyfind environment without asking the User’s permission.
12.2. By accepting the Terms of Use, the User agrees and confirms that:
12.2.1 The form and nature of the easyfind Services may change from time to time without notice;
12.2.2. Easyfind OÜmay interrupt (permanently or temporarily) the provision of the Services or any part thereof to the User at its sole discretion for the purpose of carrying out maintenance work by giving at least two working days’ notice;
12.3. Easyfind OÜ shall not be liable for any temporary interruption in the provision of its service(s) or any part thereof, if this occurs within the framework of the User’s unannounced maintenance work or due to any other circumstance for which Easyfind OÜ cannot be held liable.
12.4. Easyfind OÜ shall not be liable for the non-operation of the Service or any other failure caused by force majeure. Force majeure shall be deemed to be any unforeseeable event beyond the control of Easyfind OÜ and the User or over which they have no control, such as: fire, explosion, natural disasters, war, decisions of public authorities, as well as interruption of the Internet connection, technical failures in payment services (bank link, credit card payment, etc.), etc..
13. Easyfind OÜ’s legal remedies
13.1. If the User violates the Terms of Use or any legislation, Easyfind OÜ has the right to:
13.1.1. temporarily restrict the User’s rights to use the easyfind online environment;
13.1.2. temporarily block the User’s personal easyfind user account or business client account;
or if the User repeatedly and materially breaches the Terms of Use, Easyfind OÜ has the right to:
13.1.3. prohibit the User from using the relevant Service;
13.1.4. delete the User’s personal easyfind user account or business account;
13.2 If Easyfind OÜ receives a corresponding complaint or if it becomes apparent that Content submitted to Easyfind OÜ by the User or included by easyfind OÜ is in breach of the Terms of Use or the law, Easyfind OÜ shall be entitled to:
13.2.1. modify or delete any Content or any part of Content that does not comply with the Terms of Use or the law;
13.2.2. temporarily remove or block access to Content from the easyfind online environment without deletion.
13.3. In addition to the provisions set out in clauses 13.1. and 13.2, Easyfind OÜ has the right to claim a contractual penalty of EUR 50.- from the User for each violation and compensation for damages not covered by the contractual penalty, in particular if the User has violated the clauses of the Terms of Use in chapters 6. or 7 or 11.
13.4. easyfind OÜ shall have the right to block access to the easyfind environment to any person who uses the easyfind environment without the prior consent of easyfind OÜ in any other manner or for any other purpose than that provided for in the Terms of Use.
13.5. If Easyfind OÜ implements legal remedies, the User may lose access to the Services, his/her account data or any files or other information contained in his/her user account as a result.
13.6. In the event of a breach of a financial obligation, Easyfind OÜ has the right to suspend the performance of its obligations and to demand payment of interest on arrears at the rate of 0.06% per day.
14. Liability of Easyfind OÜ
14.1 If Users use the Services and add Content to easyfind’ s server space in the form of advertisements, advertisements, comments and images, easyfind will become aware of the corresponding Content or the User’s activities in the following ways:
14.1.1. By means of a complaint to Easyfind OÜ;
14.1.2. As a result of random checks by Easyfind OÜ administrators;
14.1.3. User’s request to Easyfind OÜ to add Content via non-automated request receipt.
14.2. Easyfind OÜ does not control the accuracy of the Content added by Users and is not responsible for it.
14.3 If Easyfind OÜ becomes aware of a (legal) infringement committed or ongoing via easyfind, it shall remove the non-compliant Content or block access to it. Easyfind OÜ shall not be liable for any infringement or the consequences of any infringement committed or continuing to be committed via easyfind.
14.4. If the User has used another person’s copyrighted work or a work derived from it in the Work, Easyfind OÜ shall not be liable for any damage caused to the User or third parties by the use of such work.
14.5. easyfind OÜ shall not be liable for the quality, quantity, location, accessories, origin or legality of the goods sold or offered for sale in the easyfind Central Shop.
15. Displaying ads
15.1. The display of advertisements on the easyfind website is based on the filter of the order of advertisements selected by the User. If the User does not select a filter but searches for a product or service using the search bar, the most relevant advertisements will be displayed above by default, taking into account the other search filters selected by the User. In the case of relevance, the listings will be displayed according to the User’s ranking in the previous search result. The User rating is displayed next to the ad. Ads with a higher rating are displayed first. In the case of an equal rating, the overall ranking filter of the search selected by the User, e.g. location, language, etc., will be taken into account. The rating is based on the value given by the Users.
15.2. For Goods and Services, the User may purchase an additional service “advertisement on the front page”, in which case the advertisement will be displayed on the main page.
16. OTHER CONDITIONS
16.1. All disputes and disagreements will be resolved through negotiation.
16.2. All disputes will be settled in accordance with the laws of the Republic of Estonia and will be subject to Estonian jurisdiction.
16.3. The User is aware thatEasyfind OÜ will, upon receipt of a corresponding request, provide information about the User and his/her related transactions to the Police and Border Guard Board, courts, Tax and Customs Board, persons who have the statutory right to receive such information and to whom Easyfind OÜ is obliged by law to forward such information.
16.4. All notifications, complaints, claims, etc. relating to the contract and its performance will be sent by e-mail. The party must ensure that the information provided by him/her at the time of registration is correct and must immediately notify any changes.
16.4.1.The notice shall be deemed to have been delivered to the Business Customer as of the business day following the day on which the notice was sent.
16.4.1.1. The user’s e-mail address is the e-mail address published when registering the account.
16.4.1.2. Easyfind OÜ’s e-mail address is: info@easyfind.ee.
16.4.2.The notice shall be deemed to have been received on the working day following the day on which it was sent, if the recipient of the notice is a legal person, and within 5 working days if the User is a natural person.
