Terms of Use
This User Agreement governs the relationship between the user (hereinafter the User), on the one hand, and Easyfind OÜ (hereinafter Easyfind OÜ), on the other hand (the User and Easyfind OÜ hereinafter jointly referred to as the Parties), in the easyfind online environment (hereinafter easyfind).
By registering and starting to use the easyfind online environment, the user confirms that:
- they have read and agree to the terms and conditions of this agreement and undertake to comply with them;
- they have read the privacy policy of the easyfind online environment, agree to it and undertake to comply with it.
1. Definitions
1.1. easyfind — a virtual environment located on the www.easyfind.ee website, its subpages and pages on social networks, which belong to the company Easyfind OÜ with registry code 16841931.
1.2. User — a natural or legal person registered in the easyfind online environment.
1.2.1. Registered User – a natural person who has registered in the easyfind online environment;
1.2.2. Business Customer – a legal entity registered in the easyfind online environment;
1.2.3. Unregistered User – a natural or legal person who uses the online environment but has not registered.
1.3. Account — a virtual account of a natural or legal person in the easyfind online environment.
1.4. Service — a service provided to the User by Easyfind OÜ (including the service of providing the User with access to the easyfind online environment, which consists of creating an account (easyfind account) for the electronic management of the User's advertisements/advertising).
1.5. Price list — a document specifying the prices (fees) for Easyfind OÜ services, which is available at https://easyfind.ee/hinnad/ and is an integral annex to the Terms of Use.
1.6. Business Day — a calendar day (from Monday to Friday between 9:00—17:00) that is not a public or national holiday.
1.7. Agreement — a document that governs the relationship between Easyfind OÜ and the User and establishes the legal basis.
1.8. Terms of Use – the general terms established by Easyfind OÜ for using the easyfind online environment and Services, which are available on the easyfind website https://easyfind.ee/kasutustingimused/
1.9. Legislation — legislation in force in Estonia.
1.10. Personal data – any information relating to an identified or identifiable natural person (data subject).
1.11. User Level – the rights granted and obligations imposed on the User for using the easyfind online environment and Services (Unregistered User, Registered User, or Business Customer);
1.12. Work – written text (advertisements, advertising, opinions, reviews, expert assessments, etc.), photographic works and works produced by processes analogous to photography, slides and slide films, short videos, audiovisual works, illustrations, etc.
2. easyfind basic terms of use for the online environment
2.1. The easyfind online environment is intended for providing Services to the User.
2.2. The easyfind online environment may only be used in accordance with the Terms of Use. If the User does not agree to the Terms of Use, the User is not entitled to register in the easyfind online environment.
2.4. Lisaks Kasutustingimustele võib Easyfind OÜ easyfind online environment. If the User does not agree to the Additional Terms of the respective Service, the User is not entitled to use that Service. The Additional Terms form part of the Terms of Use.
2.5. The easyfind website may be used only with general-purpose web browsers, such as (but not limited to): Firefox, Internet Explorer, Opera, Chrome, etc. Use of the easyfind online environment by means of programs that send automated requests to the easyfind online environment for any purpose is prohibited.
2.6. the Easyfind online environment kasutamiseks tuleb isikul sõlmida Easyfind OÜ-ga Agreement. The Terms of Use are the terms of the Agreement. The User and Easyfind OÜ may agree on contractual terms that differ from or supplement the Terms of Use.
2.7. Before entering into the Agreement, the User must thoroughly read the Terms of Use.
2.8. Depending on the User Level, the Agreement with Easyfind OÜ is concluded as follows:
2.8.1. when the User actually begins using the Services (Unregistered User);
2.8.2. if the User has submitted an application for registration through the easyfind online environment and gains access to a personal easyfind user account (Registered User);
2.8.3. The Company has submitted an application for registration through the easyfind online environment and gains access to the easyfind business account (Business Customer)
2.9. If the User wishes to use easyfind in a manner or for a purpose other than that provided for in the Terms of Use, prior written consent from Easyfind OÜ is required. Without prior written consent from Easyfind OÜ, use of the easyfind online environment in a manner or for a purpose other than that provided for in the Terms of Use is prohibited.
2.10. The User is obliged to pay for the use of the Services of the easyfind online environment in accordance with the Price List, unless otherwise stipulated in the Agreement.
2.11. Conditions required for concluding an agreement with Easyfind OÜ:
2.11.1. To conclude an agreement with Easyfind OÜ, a User who is a natural person must be an adult (at least 18 years old).
2.11.2. The Agreement may be concluded on behalf of a legal entity by its legal representative.
2.11.3. To conclude the Agreement, the ability to use Smart-ID, Mobiil-ID, or an ID card, a Google account, or an email address is required.
3. User Levels
3.1. The following User Levels are defined in the easyfind online environment:
3.1.1. Unregistered User – may use the Services of the easyfind online environment to a limited extent without the need to create a personal easyfind user account. The rights and obligations of a Registered User do not apply to an Unregistered User;
3.1.2. Registered User – may use the Services of the easyfind online environment and offer their goods and services to other Users, and rate Users with whom they have conducted transactions. In addition, the rights and obligations set out in the Terms of Use of the easyfind online environment apply to the Registered User.
3.1.3. Business Customer – may use easyfind Services and offer its goods and services to other Users, rate Users with whom it has conducted transactions, and only a Business Customer may publish information about engaging in the sale of used items.
3.2. A General User has the right to:
3.2.1. view the Content of the easyfind online environment;
3.2.2. perform searches in databases (a General User can see only the names of other Users, but not their contact details or the information published by them), and use other Services available to a General User;
3.2.3. create a personal easyfind user account (Registered User) or Business Customer account. In both cases, an agreement must be concluded with Easyfind OÜ by accepting the easyfind online environment Terms of Use and Privacy Policy.
3.3. A Registered User has the right to:
3.3.1. log in to the easyfind page;
3.3.2. store data about Users of interest in the personal easyfind user account;
3.3.3. receive new advertisements from saved Users of interest by email;
3.3.4. view the registered User and contact them through the easyfind website. Send purchase enquiries to sellers of a product, service or other offering of interest and request additional information;
3.3.5. provide a rating of the Business Client/Registered User and leave feedback in the comments regarding the goods or services received.
3.3.6. use all other Services available to the Registered User.
3.3.7. add their own listings, advertisements, discounts and other campaigns.
3.4. The Business Client has the right to:
3.4.1. log in to the easyfind online environment page;
3.4.2. use the Services available through the Business Customer account and other Services in accordance with the agreement entered into with Easyfind OÜ;
3.4.3. authorise natural persons acting on behalf of the company to use their user account.
3.4.4. advertise used items via the easyfind online environment.
4. Registration, Term and Termination of the User Agreement
4.1. Upon registration, the User must provide the mandatory data marked with an asterisk as required by Easyfind OÜpoolt, accept the Terms of Use, Privacy Policy and price list by clicking the designated field created by Easyfind OÜon in the registration user interface.
4.2. Upon registration, in addition to other rights, the User will also receive a personal easyfind user account or, in the case of a company, a business customer account.
4.3. If the User has both a user account and a business account, the User may choose whether to use the user account or the business customer account.
4.3. If the User fails to pay on time for the use of the easyfind online environment services, their account will automatically become inactive, other Users will not be able to see information associated with the account, and the User will not be able to publish information.
4.3.1. If the User wishes to reactivate their account, provided that it or parts thereof have not been deleted in accordance with the retention periods for Personal Data arising from the Privacy Terms, the prescribed amount and/or outstanding balance must be paid according to the price list applicable to the use of easyfind services, after which the account will become active no later than one working day after the financial obligation has been fulfilled and a notification thereof has been sent to Easyfind OÜ.
4.4. The User's registration with easyfind is valid indefinitely. The User's account is active if the User has paid for it according to the price list. The User can choose whether the active period lasts one month or one year.
Kui Kasutaja ei ole oma kasutajakontot või ärikontot 365 päeva kasutanud, teeb Easyfind OÜKasutajale kasutajakonto või ärikliendikonto kustutamise hoiatuse. Kui Kasutaja sellele ei reageeri, kustutab Easyfind OÜ kasutajakonto või ärikliendikonto.
4.5. The Client has the right to terminate the User Agreement and close the user account at any time.
4.6. If a material breach of the terms of the Agreement by the User is identified, Easyfind OÜ has the right to terminate the user agreement extraordinarily.
5. Identification of the person and user account
5.1. The Registered User and Business Customer are obliged to keep the information required to access the easyfind environment confidential and in such a way that it does not come into the possession of third parties, except where the Registered User has authorised a third party to use their data to access the Services.
5.2. The User must immediately notify Easyfind OÜ of the loss of their username or password or if they come into the possession of persons whom the User has not authorised to use the data. The notification must be digitally signed.
5.3. The User is responsible for transactions made using their account and for information published in their name.
5.4. To use certain Services, Easyfind OÜ may require the User's identity to be verified using an ID card, Mobile-ID or Smart-ID.
6. User rights, obligations and restrictions
6.1. easyfind allows the User to register and use only one Registered user account in the online environment, but the User may be associated with one or more business accounts.
6.2. The User has the right to purchase services or products published in the easyfind online environment and to publish a listing or advertisement in their own name solely in respect of a service offered or product sold by the User.
6.3. The User undertakes to act in the easyfind online environment in accordance with the User Agreement and the legislation of the Republic of Estonia.
6.4. The User undertakes to be responsible for the content of listings published in the easyfind online environment, the quality and availability of services and products, as well as the accuracy of their presentation.
6.5. The User is responsible for the proper fulfilment of the obligations they have assumed in the easyfind online environment.
6.6. The User must provide only accurate information in the easyfind online environment.
6.7. The User is required to immediately notify Easyfind OÜ of all problems encountered when using the easyfind online environment, clearly stating the nature of the problem.
6.8. The User is required to inform Easyfind OÜ of any circumstances that may prevent the proper fulfilment of these terms and conditions.
6.9. The User grants Easyfind OÜ non-exclusive ownership of the audiovisual content of their advertisements, including texts, and undertakes to refrain from activities that could place an excessive load on the easyfind online environment's infrastructure.
6.10. The User undertakes to refrain from using any automated programs to collect or gain access to information contained in the easyfind online environment.
6.11. The User must ensure that files uploaded by the User to the website and easyfind messages sent to the online environment or another User by email do not contain computer viruses or other computer programs or files that damage or otherwise disrupt, or may damage or disrupt, the normal operation of the website, nor any programs or files that may be stored on the computers of other website Users, damage them, or disrupt the normal functioning of those computers.
6.12. It is prohibited to use another person's copyrighted Work or a Work derived from it without the consent of the Work's copyright holder (author, performer, licensee, employer, database maker, etc.). The User shall ensure that adding the Work to easyfind complies with applicable legislation.
6.13. If a User publishes ratings in the easyfind online environment regarding another User or a product or service offered by that User, they must be honest and objective, and in the event of a dispute, the person who gave the rating must be able to justify and substantiate it.
6.13.1. A value judgement must not defame, demean, ridicule or insult the honour and good name of another person, nor may its purpose be to maliciously or unjustifiably disparage a service or product.
6.13.2. The User acknowledges that providing false information may cause damage to another User or the manufacturer of a product, and that they will have the right to claim, among other things, compensation for the damage caused.
6.13.3. The User is aware that, OÜ Easyfind, will disclose the details of the User who made the value judgement to a person who believes that their rights have been infringed by an incorrect value judgement.
6.13.4. The User is aware that OÜ Easyfind does not verify published ratings.
6.13.5. Incitement to hostility and hatred, persecution, as well as discrimination based on gender, race, ethnicity or religion, beliefs, or inequality of financial or social status is also prohibited.
6.13.6. A rating of a product or service may only be given by a User who has personally purchased the product or used the service. A rating may not be based on claims made by third parties.
6.13.7. OÜ-l Easyfind has the right to delete reviews and/or suspend their publication.
6.14. It is prohibited to burden the easyfind environment with information unrelated to the purpose of that environment.
6.15. The User must keep confidential any personal data and confidential information that becomes known to them while using the easyfind online environment, including, but not limited to, the identities of other Users, unless the right or obligation to disclose arises from law or the relevant person has consented to the disclosure.
6.16. Easyfind OÜ-lon has the right, BUT NOT THE OBLIGATION, to monitor the information added by the User and the actions of Users in the easyfind online environment and to remove non-compliant information, restrict the publication of non-compliant information, or restrict non-compliant activity.
6.17. Easyfind OÜ is not obliged to monitor Users' activities or any information they add and transmit, cache or store via the easyfind online environment, or to search for facts or circumstances indicating illegal activity. However, Easyfind OÜ is obliged to provide information to competent authorities, such as the Police and Border Guard Board, the Data Protection Inspectorate, the Tax and Customs Board, etc., upon their request.
6.18. The User and Easyfind OÜ shall resolve any dispute between them through negotiations. If no resolution can be reached through negotiations, the dispute shall be resolved in accordance with the laws of the Republic of Estonia, and, in the case of a User that is a legal entity, by Harju County Court.
6.19. Easyfind OÜand the User may not publish links to third-party websites in the easyfind online environment.
6.20. Third-party services and websites may be subject to terms and principles that differ from the Terms of Use and Privacy Policy and whose application Easyfind OÜcannot control. Easyfind OÜis not responsible for the content or operations of third-party services and websites, or for the practices, rules and principles applicable there. The User is required to familiarise themselves with the practices, rules and principles applicable on third-party websites.
6.21. The User has the right to submit complaints concerning the functioning of the website or violations by other Users to Easyfind OÜ. They must be sent by email to: easyfind@easyfind.ee
7. Publishing an advertisement/promotion and using other services
7.1. When submitting an advertisement, photo, video, advertising or text, the User is required to provide only true and accurate information. The User is prohibited from publishing information that is misleading or inaccurate. Texts, photos, videos and information published by the User through the easyfind online environment must comply with legislation, good practices and customs. By accepting these Terms of Use, the User confirms that the information they publish through the website:
7.1.1. are not misleading, inaccurate or incorrect;
7.1.2. do not contain offers to provide services or sell goods whose provision or sale does not comply with legislation;
7.1.3. do not infringe the proprietary or non-proprietary rights of third parties, including intellectual property rights belonging to third parties;
7.1.4. are not contrary to legislation or good morals and practices.
7.2. The User is responsible for the accuracy of the information they publish.
7.2.1. Easyfind OÜis not responsible for the accuracy of information published by the User, the quality of a product or service offered by the User, or the performance of a contract concluded between Users.
7.2.2. All advertisements and comments added by the User to the easyfind online environment undergo prior moderation. Advertisements and comments become visible on the website no later than one business day after submission, provided that they comply with the Terms of Use and do not violate the legislation of the Republic of Estonia.
7.3. The User undertakes to inform Easyfind OÜ immediately by email if any data published by the User via the easyfind website has become inaccurate, incorrect or unlawful after publication.
7.4. Easyfind OÜ is entitled to choose its contractual partners at its own discretion.
8. Basic terms for advertisements
8.1. The advertisement must be clear and the information published in it must be true; among other things, the advertisement must not unjustifiably give the impression, for example, that the information presented has a scientific basis (RekS § 3 subsection 4 clause 11 and clause 14).
8.2. The User acknowledges that they are responsible for substantiating the truthfulness of any advertising claims.
8.3. When publishing information, the User must comply, among other things, with the Advertising Act.
8.3.1. Section 3 of the Advertising Act sets out the basic requirements for advertising, and subsection 4 of the same section sets out the restrictions that the User must observe when publishing information on the easyfind portal.
8.4. Processing an advertisement, photo or other file for the purpose of attracting attention is prohibited.
8.5. Photos or other files added to an advertisement's photo fields may depict either specific or different products/services. The User chooses the design of their advertisement/promotion and how information is communicated to others, but it must comply with the terms and conditions of the easyfind online environment.
8.6. The User specifies in their account which words are used as search terms (words that make it easier to find a specific product or service). Search terms must consist of either one word or a maximum of two words and must be clear and specific (for example, “hairdresser”, “house cleaning”, “washing machine repair”, etc.). The number of search terms is not limited, but they must be related to the User who published the advertisement and/or their activities.
8.7. Rules for the “Work/workspace rental” category.
8.7.1.Principles
- The job title and the description of the duties stated in the job advertisement must correspond to each other so that the duties and/or position are clear;
- The duties and conditions, including requirements for the applicant (such as foreign language proficiency, possession of a driving licence, etc.), must be described as clearly as possible;
- A job advertisement may be added only by the legal representative of the company offering the job.
8.7.2. If so-called workstation rental is offered (hairdressers, beauty services), it must be clearly distinguishable from a job advertisement.
8.7.3. The advertisement title must contain only the job title (in the nominative case).
8.8. It is prohibited to publish information:
- concerning a product or service whose sale or provision is illegal;
- regarding intimate services;
- whose published content is contrary to the Advertising Act or any other legal provision of the Republic of Estonia;
- that is contrary to the user agreement;
8.9. It is prohibited to publish advertising concerning the following persons or services:
8.10. Only information appropriate to the designated fields (corresponding to the field name) may be entered there.
8.11. Texts must comply with spelling rules. The use of inappropriate characters or repeated characters is prohibited.
8.12. Advertisements must correspond to the category under which they are intended to be published. For example, it is prohibited to add car repair services or other advertisements to the organic products category.
8.13. The User may provide links to their website and online store.
8.14. The User may advertise their business or activities using images, text, pdf files, short viideos, slides and slide shows.
8.15. Only a Business Customer may sell or advertise used products.
8.16. The User is not permitted to sell prohibited goods, services or products that violate Easyfind OÜ intellectual property rules, even if they comply with Easyfind OÜ other marketplace terms.
8.17. Resale is prohibited in the handmade (goods) category. Resale means offering for sale a handmade item that was neither designed nor made by the User.
Please note that members and, in some cases, third parties may report advertisements that they believe violate Easyfind OÜ rules or the interests or rights of a third party, such as a manufacturer, product reseller, owner of an item, etc., and ask Easyfind OÜ to review them, including suspending them or requiring the publisher of the information to disclose their personal data. Easyfind OÜ may remove any advertisements or other information or content that violates the Easyfind OÜ user agreement. If Easyfind OÜ has suspended the User's account due to any violations, payments made for services will not be refunded.
8.18. Duplication of advertisements, i.e. repeatedly posting advertisements with the same or very similar content, is prohibited, including for the purpose of gaining more visibility on the homepage or in search results. Easyfind OÜ has the right to remove duplicate advertisements without prior notice.
9. Conclusion of sales transactions and liability
9.1. Easyfind OÜdoes not itself participate (for example, as an agent, broker, commission agent, representative or otherwise) in actual sales or other transactions conducted between Users as a result of offers published in the easyfind online environment.
9.2. Users conclude sales transactions in the easyfind online environment without the intervention of Easyfind OÜand are fully responsible for the performance of the contracts concluded between them and the terms of sale.
9.3. The User understands and is aware that if the other party to the transaction, who sells something or provides a service, is not a trader, then the consumer rights arising from European Union consumer protection law do not apply to the contract concluded between the Users as a result of an offer published in the easyfind online environment.
9.4. If Easyfind OÜbecomes aware of an infringement committed or ongoing via the website, it will remove the relevant content or block access to it. Easyfind OÜis not liable for infringements committed or ongoing via or through the easyfind online environment or for their consequences, including where those consequences arise from a breach of obligations under a contract between two Users.
9.5. Easyfind OÜ is not liable for damage incurred by the User or third parties in connection with Easyfind OÜ's use of its legal remedies (for example, removing content from the website, blocking access to it, restricting the User's rights or blocking their access to their user account or website), if this was necessary due to a complaint about a breach submitted to Easyfind OÜ or a suspicion of a breach arising at Easyfind OÜ, or directly because the content or the User's conduct is contrary to the Terms of Use, good practice or legislation. In such cases, Easyfind OÜ is not liable for any resulting damage, even if the complaint was unfounded or it later turns out that no breach had occurred.
9.6. If the User has used another person's copyrighted work or a derivative thereof in the easyfind online environment, or has otherwise infringed someone's copyright, Easyfind OÜis not liable for damage caused to the User or third parties by the use of such a work. The User shall resolve all such disputes and bear the associated costs.
9.7. Easyfind OÜis not responsible for the quality, quantity, location, accessories, origin or legality of goods sold, nor for the quality of a service offered by the User. Responsibility lies with the User who sells the goods, provides the service or published the relevant advertisement.
9.8. OÜ Easyfind OÜ ei ole Kasutajate vaheliste vaidluste lahendajaks ega lahenda Kasutaja pretensioone teise Kasutaja vastu, mis puudutab toodet, teenust, autori- või muude õiguste rikkumist.
10. Rights and obligations of Easyfind OÜ
10.1. Easyfind OÜ has the right to unilaterally amend the Terms of Use and price lists in accordance with the development of the Services and the easyfind website.
10.2. Easyfind OÜ may amend the Terms of Use if required by changes in applicable legislation or its interpretation, the launch of a new Service or discontinuation of an existing Service, in response to continuous complaints from Users, upon the issuance of a final court judgment or administrative act requiring the amendment of the Terms of Use with respect to Easyfind OÜ, where necessary to strengthen the protection of User data, in the event of changes to the operating arrangements of the easyfind online environment, or in response to technological developments that enable improvements to the management of the easyfind website or to the quality and security of the Services.
10.3. Users will be notified via the Website of changes to the Terms of Use or price lists Easyfind OÜin good time before the new Terms of Use or price lists take effect. If the User continues to use the easyfind website and the Service after the expiry of the specified period, they will be deemed to have accepted the changes to the Terms of Use and/or price lists. Changes that have taken effect do not apply to Services that were paid for or entered into before the changes took effect.
10.4. Easyfind OÜ has the right to restrict the User's rights when using the easyfind website or terminate the User's registered status if the User violates these Terms of Use. In certain cases, an additional period will be granted to remedy the violation, depending on the extent, nature, and possible consequences of the violation, including the existence of previous violations.
10.5. Easyfind OÜ has the right, but not the obligation, to review advertisements, texts and photos submitted by the User on the easyfind website and remove advertisements that contain inaccurate or misleading information, whose publication would constitute a violation of the law, or through whose publication the User has otherwise violated the Terms of Use.
10.6. Easyfind OÜ has the right to restrict access to the easyfind website for persons who do not comply with these Terms of Use or who violate legislation while using the easyfind website. If the User's rights are restricted, the User will be notified thereof, and any disputes will be resolved through negotiations or in court.
10.7. Easyfind OÜ reserves the right not to refund the User any fee paid for any service if the User decides to discontinue the service before the end of its term or if the contract is terminated due to a breach by the User.
11. Copyright
11.1. Easyfind OÜ owns all copyrights and related rights (database maker's rights) to the databases and the works contained therein, including software, news, messages and texts published by Easyfind OÜ, and the graphic, musical and other design of easyfind’.
11.2. The Works for which the economic rights are assigned and an exclusive licence is granted in respect of personal rights under this chapter are written texts published or to be published by the User in the easyfind environment, including advertisements, forum posts, opinions, reviews, expert assessments and the like, photographic works and works produced by methods analogous to photography, slides and slide films, audiovisual works, illustrations, and the like.
11.3. The User assigns to Easyfind OÜ, free of charge, all economic rights to the Work listed in clause 11.2 within the meaning of the Copyright Act, including the rights to reproduce, distribute, translate, adapt, compile, and create databases from the Work, publicly perform it, make it available to the public, etc., in any form and by any means, without geographical restrictions, for the entire term of copyright protection and without restrictions in relation to third parties. The economic rights are deemed to be assigned to Easyfind OÜ immediately upon uploading the Work to the Easyfind OÜ environment.
11.4. With respect to the Works listed in clause 11.2, the User grants Easyfind OÜ a free exclusive licence (permission) to use the User's moral rights in the easyfind online environment in any form and manner within the meaning of the Copyright Act, without geographical restrictions and for the entire term of copyright, without limitation in relation to third parties. The User restricts the manner and scope of exercising their moral rights as set out in the Terms of Use. Easyfind OÜ is entitled to grant sublicences in respect of the User's moral rights. The exclusive licence is deemed to be granted by the User to Easyfind OÜ immediately upon uploading the Work to the easyfind environment. The exclusive licence granted under the Terms of Use covers all further developments of the Work. The User agrees, where necessary, to make any changes to their Work and the designation of the User's name, and to add other works, illustrations, comments, etc. to their Work. The User agrees that Easyfind OÜ is not obliged to identify the User as the author of the Work.
11.5. Easyfind OÜ-l on õigus luua Kasutaja Teose alusel tuletatud teoseid Teose edasiarendamise teel. Autoriõigus tuletatud teostele kuulub Easyfind OÜ-le. Kasutaja on nõus, et Easyfind OÜei ole kohustatud kajastama tuletatud teose juures Kasutaja kui algse Teose autorinime, Teose pealkirja (nimetust) ega allikat, kus Teos on avaldatud. Tuletatud Teosed on näiteks Kasutaja poolt easyfind keskkonda üles laetud fotod täienduste, muudatuste või muude lisamistega (sealhulgas fotode mõõtude muutmine, failinime muutmine, foto kvaliteedi tõstmine, vesimärgi lisamine, jms). Easyfind OÜ-l on õigus Kasutaja poolt easyfind internetikeskkonda üleslaetud Teosed (näiteks fotograafiateosed) kustutada ja kasutada easyfind keskkonnas vaid Easyfind OÜpoolt loodud tuletatud teoseid.
11.6. Neither the User nor any other person is entitled, without the prior written consent of Easyfind OÜ, to reproduce (copy), distribute, transmit, translate, incorporate into other databases, extract or otherwise use the easyfind environment or any of its components.
11.7. Use by the User or any other person of easyfind or any Works forming part thereof without Easyfind OÜconsent is unlawful and entails liability as provided by law.
11.8. By commencing use of the easyfind online environment, the User confirms that they are aware of Easyfind OÜ's copyrights and related rights (database producer's rights) and undertake not to infringe Easyfind OÜ's rights or allow persons associated with them to infringe Easyfind OÜ's corresponding rights.
11.9. By adding Works or Content to the easyfind environment, the User confirms that they own the copyright or other intellectual property rights to the Work or Content or have another legal basis for adding the Work or Content.
11.10. Easyfind OÜ and the User are liable for breaches of the copyright requirements set out in this section of the Terms of Use, subject to the exceptions set out in the section “Easyfind OÜ liability” (see clause 14 of the Terms of Use).
12. Quality and availability of Services
12.1. Easyfind OÜmay, where necessary, update the mechanisms underlying the operation of the easyfind environment in order to provide Users with the best service, without requesting the User’s permission.
12.2. By accepting the Terms of Use, the User agrees and confirms that:
12.2.1. The form and nature of easyfind Services may change from time to time without prior notice;
12.2.2. Easyfind OÜmay, at its discretion, suspend (permanently or temporarily) the provision of Services or any part thereof to the User in order to carry out maintenance work, giving at least two business days’ notice ;
12.3. Easyfind OÜis not liable for the temporary interruption of the provision of the service(s) it offers, or any part thereof, if this occurs during maintenance work of which the User has been notified, or due to any other circumstance for which OÜ Easyfind cannot be held liable.
12.4. Easyfind OÜis not liable for the Service being unavailable or for any other failures caused by force majeure. Force majeure means any unforeseeable event beyond the control of Easyfind OÜ or the User, or over which they have no control, such as fire, explosion, natural disasters, war, decisions of authorities, as well as interruption of the internet connection, technical failures in payment services (bank links, credit card payments, etc.), and so on.
13. Legal remedies of Easyfind OÜ
13.1. If the User violates the Terms of Use or legislation, Easyfind OÜ has the right to:
13.1.1. temporarily restrict the User's rights to use the easyfind online environment;
13.1.2. temporarily block the User's personal easyfind user account or business customer account;
13.1.2.1 for three days in the event of the first violation;
13.1.2.2. for seven days in the event of a second violation;
or if the User repeatedly or materially violates the Terms of Use or has received 3 notices of infringement from Easyfind OÜ, Easyfind OÜ has the right to:
13.1.3. prohibit the User from using the relevant Service;
13.1.4. delete the User's personal easyfind user account or business customer account without the option to create a new account in the future;
Please note that no violation notice is issued for the first violation of the rules.
13.2. If a corresponding complaint is submitted to Easyfind OÜ or it becomes apparent that the Content submitted by the User to Easyfind OÜ or added to easyfind’ is contrary to the Terms of Use or legislation, Easyfind OÜ has the right to:
13.2.1. modify or delete non-compliant Content or part thereof if it is evident that it does not comply with the Terms of Use or legislation;
13.2.2. Temporarily remove Content from the easyfind online environment or block access to it without deleting it.
13.3. In addition to the provisions of clauses 13.1. and 13.2, Easyfind OÜ has the right to demand that the User pay a contractual penalty of 50.- euros for each violation and compensate for any damage not covered by the contractual penalty, especially if the User has violated the subclauses of the Terms of Use in chapters 6., 7, or 11, as well as the clauses specified in the rule “Advertising prohibitions and restrictions” .
13.4. Easyfind OÜ is entitled to block access to the easyfind environment for any person using the easyfind environment without Easyfind OÜ's prior consent in a manner or for a purpose other than that provided for in the Terms of Use.
13.5. If Easyfind OÜ applies legal remedies, the User may consequently lose access to the Services, their account data, or any files or other information contained in the user account.
13.6. In the event of a breach of a financial obligation, Easyfind OÜ has the right to suspend the performance of its obligations and charge täitmine ja nõuda viivise määraga 0,06% per day.
14. Liability of Easyfind OÜ
14.1. When Users use the Services and add Content to easyfind server space in the form of advertisements, advertising, comments and images, easyfind becomes aware of the relevant Content or Users' activities in the following ways:
14.1.1. by submitting a complaint to Easyfind OÜ;
14.1.2. As a result of random checks by Easyfind OÜ administrators;
14.1.3. upon receipt of a non-automated request from the User to add Content to Easyfind OÜ.
14.2. Easyfind OÜdoes not verify the accuracy of Content added by Users and is not liable for it.
14.3. If Easyfind OÜbecomes aware of an infringement (or continuing infringement) committed through easyfind, it will remove the non-compliant Content or block access to it. Easyfind OÜis not liable for any infringement committed or continuing through easyfind, or for its consequences.
14.4. If the User has used in a Work another person’s copyrighted work or a work derived from it, Easyfind OÜis not liable for any damage caused to the User or third parties by the use of such work.
14.5. Easyfind OÜis not liable for the quality, quantity, location, accessories, origin or legality of goods sold or offered in the easyfind environment.
15. Displaying advertisements
15.1. When advertisements are displayed on the easyfind website, they are ordered according to the advertisement sorting filter selected by the User. If the User does not select a filter but searches for a product or service using the search bar, the most relevant advertisements are displayed first by default, taking into account the other search filters selected by the User. Where relevant, advertisements are displayed according to the User's rating in the previous search result. The User's rating is displayed alongside the advertisement. Advertisements with a higher rating are displayed first. If the ratings are equal, the general search sorting filter selected by the User is applied, e.g. location, language of communication, etc. The rating is based on evaluations provided by Users.
15.2. For goods and services, the User may purchase the additional service “listing on the front page”, in which case the listing will be displayed on the front page.
16. OTHER TERMS
16.1. All disputes and disagreements shall be resolved through negotiations.
16.2. All disputes shall be resolved in accordance with the laws of the Republic of Estonia and shall be subject to the jurisdiction of Estonian courts.
16.3. The User acknowledges that, upon receipt of a corresponding request, Easyfind OÜ provides information about the User and transactions related to the User to the Politsei- ja Piirivalveamet, courts, Maksu- ja Tollimaet, persons who have a statutory right to receive such information, and persons to whom Easyfind OÜ is legally obliged to provide such information.
16.4. All notices, complaints, claims, etc. related to the agreement and its performance shall be sent by e-mail. The Party must ensure that the information provided by it upon registration is correct and immediately report any changes thereto.
16.4.1.A notice shall be deemed delivered to the Business Customer on the business day following the day on which it was sent.
16.4.1.1. The User's e-mail address is the e-mail address provided when registering the account.
16.4.1.2. Easyfind OÜ the email address is: info@easyfind.ee
16.4.2.The notice is deemed to have been received on the working day following its dispatch if the recipient is a legal person, and within 5 working days if the User is a natural person.
17. The Price List, Privacy Policy, and “Advertising prohibitions and restrictions” form integral annexes to the Terms of Use.
